Alabama Uninsured Motorists

Uninsured motorist and under-insured motorist coverage is a portion of an individual’s insurance policy that allows a car accident victim to utilize their own policy in the event that the at-fault driver either has no insurance or not enough insurance to fully compensate the injured party. This type of coverage is also used in hit-and-run accidents.

If you have been involved in a car accident in Mobile or Baldwin County and the at-fault driver has little to no insurance or fled the scene of the collision, contact our Alabama Uninsured Motorists lawyers today for a free consultation.

Uninsured Motorist Coverage

In the state of Alabama, all auto insurance companies are required to provide uninsured and under-insured motorist coverage on every policy they offer, regardless of whether that type of coverage is requested. The only way an insurance provider can legally not provide this coverage under Alabama’s Uninsured Motorist Statute is to have the insured party sign a written wavier stating that they elect to not receive this coverage.

A unique aspect of Alabama’s Uninsured Motorist Statute is that it allows individuals to stack or add vehicle’s coverage amounts together. This means that if you have three cars, each with a minimum coverage of $25,000, and you were in an accident with an uninsured driver where the damages totaled more than $25,000, you have the opportunity to stack the coverage of the other vehicles to cover up to $75,000 worth of losses. You are only allowed to stack three cars on one insurance policy in Alabama; however, you can stack an unlimited number of policies.

Under-Insured Motorist Coverage

There are several types of auto insurance policies that are available to drivers. With that in mind, you may be involved in a car wreck and the at-fault driver’s policy does not provide sufficient coverage for you to recover all your losses.

When this happens, it is advisable to have an experienced attorney review your own policy to see if under-insured motorist coverage is a plausible and reasonable means of compensation.

If the at-fault driver’s policy does not provide enough compensation for your damages, you may be able to receive coverage from your own provider for the amount that exceeds the other party’s policy.

Hit-and-Run Accident Coverage

When the at-fault driver leaves the scene of the crash, you may be able to make a hit-and-run claim with your provider. If successful, your insurance company will behave as if it were the at-fault driver’s provider and cover your damages from the collision.

When this happens, however, your provider may not have your best interests at heart. With a knowledgeable hit-and-run attorney by your side, your chances of receiving fair compensation for your injuries and property damage significantly increases.

Uninsured Motorist Lawsuits in Mobile and Baldwin Counties

In 2010, Alabama ranked third in the United States for uninsured drivers. More than 26 percent of drivers at that time had no form of car insurance.

Regardless of the insurance status of the at-fault driver, you may be entitled to compensation if you have been injured or sustained property damage in a Mobile or Baldwin County auto accident.

A car accident victim’s approach to recovering losses after a collision has occurred can affect the outcome of their claim. An experienced Alabama car wreck attorney from Citrin Law Firm can help you with your lawsuit and increase your chances of receiving fair compensation for your losses.
